What is a prenuptial agreement and who needs one?

A prenuptial agreement (“prenup”) is a contract entered into by two people planning to get married to set forth rights of each party in the event of a divorce. Parties owning considerable assets prior to the marriage typically execute prenuptial agreements. In the event of a divorce, these parties try and keep those assets separate from the marital property.

How does social media play into a prenuptial agreement?

According to an ABC News report, a growing number of couples are including social media clauses in their prenup. No nude, embarrassing or professionally damaging content are typical clauses added to prenups. Since social media has become the norm, people are constantly updating their status, tagging pictures and locations 24/7. Certain subject matter should be avoided on social media, especially if it can affect the family. In cases of prominent or well-known family, protecting the reputation of the family name is often extremely important. Another reason why a couple may include social media clauses in their prenup is when one spouse is a business owner, high-level employee or partner. Certain posts, photographs or comments may portray a negative light on the business.

  1. Tagging locations
  2. Amount of social media applications
  3. Accepting friend/follower requests and requesting to follow/following others
  4. Pictures and posts related to current and/or future children
  5. Pictures and posts related to other family members
  6. Access to one another’s accounts and/or the use of joint accounts
